H & C Applications

H & C Applications are applications or appeals for PR made on Humanitarian and Compassionate grounds under Canadian Immigration. The rules governing such application are laid down under Section 25 of the IRPA.

Such applications are approved based on the personal circumstances of each application. Assessment is made on the basis of information provided by an applicant.

H & C Application Eligibility

The applicants are eligible to apply under this category if they:

  • Are family members of a Canadian Citizen or a permanent resident of Canada.
  • Have a history of steady employment in Canada and file regular income tax returns and pay taxes regularly.
  • Are studying in Canada
  • Demonstrate language proficiency in English or French.
  • Have investments been made in Canada and future financial commitments and investments?
  • Own property in Canada.
  • Are integrated into the community.

Who may not use this application?

  • A Canadian citizen,
  • A permanent resident,
  • have submitted an H&C application for which a decision has not been made
  • have an outstanding refugee claim,
  • became a designated foreign national within the last 5 year

H & C Applications require the applicants to include a detailed letter with their application elaborating the type of hardships they would face if their application is rejected. The supporting documents need to be quite compelling and convincing in this case.
