This permit exists so that you do not have to choose between staying safe and staying in status. It is decided quickly, and you do not need your employer to agree or even to know.

Who Is the Vulnerable Worker Permit For?
This permit exists for one situation: a worker in Canada who is being abused, or is at risk of abuse, in relation to their employment, and who is tied to the employer causing it by an employer-specific work permit. It allows that worker to leave without losing status, which is the whole point of it. It is issued under section 207.1 of the Regulations.
Core Eligibility:

You are physically present in Canada, and the application is made from inside Canada

You are experiencing abuse, or are at risk of abuse, in relation to your employment in Canada

You hold a valid employer-specific work permit, or you applied to extend one before it expired

It cannot be applied for at a port of entry, and it cannot be applied for at an IRCC office abroad
The permit is intended to remove the trap, not to reward leaving a job you dislike. The abuse must relate to your employment, and IRCC assesses it on evidence.
What Counts as Abuse?
IRCC defines abuse broadly, as any behaviour that scares, controls or isolates you. Workers routinely underestimate what qualifies, and stay in situations that would meet the test.
Forms of Abuse Recognised by IRCC:

Physical abuse, including assault and forcible confinement

Sexual abuse, including any sexual contact without consent

Financial abuse, including wage theft, unpaid overtime, and unauthorized recruitment fees charged to you

Psychological abuse, including threats, intimidation, isolation and threats to report you to authorities

Unsafe working conditions, and retaliation for reporting them or for cooperating with an inspection
Guidance was updated on 6 February 2026 with direction on interviews, missing documents, supporting evidence and situations that may not constitute abuse. Where a situation is borderline, the quality of the evidence submitted decides the outcome.

What Makes an Application Succeed?
These applications are assessed quickly by design, because the worker is by definition in a difficult position. That speed cuts both ways: a thin application is refused just as quickly.
What Strengthens a File:
-
A clear, dated, first-person account of what happened, written as evidence rather than as complaint

Contemporaneous corroborationpay records, messages, rosters, medical notes, photographs of conditions

Evidence of the employment relationship and of the employer-specific condition on your permit

Any report made to a provincial labour board, occupational health and safety body, or the police
-
A statement from a colleague, support worker or settlement organisation where one is available
This is the single most common misunderstanding we see, and the fear it creates is what keeps people in jobs they should have left.
- Not working for the employer named on your permit is not a status violation. A closed work permit authorises you to work for that one employer. If you stop, you have simply stopped using the authorisation. Your temporary resident status continues until the permit expires. You are lawfully in Canada.
- What you cannot do is work for anyone else. That is the real limit. You may remain in Canada, but until you hold a permit that allows it, working for a different employer is the breach, not leaving the first one.
- That gap is the space in which you act. It is when you apply for the vulnerable worker open work permit if it applies to you, and those applications are processed quickly and without your employer being told.
- You can also change to another status you qualify for. A study permit, a different work permit, or visitor status, applied for before your current permit expires.
- If the permit does expire, you are not finished. You have ninety days to apply to restore your status. You may not work or study while restoration is pending, and it cannot itself be restored, so the ninety days is the whole of your margin.
One caution that runs the other way, if you are thinking of switching to a study permit. A study permit does not protect you simply by being valid. You have to actively pursue your studies. Under IRCC’s compliance guidance, a student who stops studying has 150 days to resume studies, change to another status, or leave Canada. Past that, you are treated as being out of status even though the permit on paper still shows two years left. A valid document and valid status are not the same thing.
