A Canadian immigration refusal can often be overturned.
A refusal is not always the end of the road. Depending on the reasons, a refused application can be responded to, reconsidered, reapplied for correctly, appealed, or challenged in the Federal Court. The first step is a proper reading of your refusal or procedural fairness letter, and an honest view of whether a realistic path exists.

If you have been refused
Time is not on your side. Every day counts.
A refusal is not always your fault. It can come down to an oversight, a document the officer did not properly weigh, or a plain mistake, and yes, IRCC gets it wrong too. We are seeing more refusals than ever right now, and some of your options carry hard deadlines. Once they pass, they are gone.
Before you react, get a clear read on where you stand. Depending on your situation the right move might be a reconsideration request, a fresh application, sometimes both at once, judicial review at the Federal Court, or something else entirely. Every case is different, and the wrong move can cost you the one that would have worked. That is exactly why it pays to consult us first.
You will speak with an RCIC or a lawyer directly, not a call centre. No credit card, no obligation.

A refusal is not always the end
Why a refusal is worth a proper second look
Officers refuse applications for specific reasons, and those reasons are not always correct, complete, or fatal. Some refusals come down to a document that was not properly explained, a concern that was never put to the applicant, or an assessment that does not hold up in law. A refusal that is read carefully, and answered on its actual grounds, can frequently be turned around. What matters is doing it properly, and quickly, because procedural fairness letters and appeal periods run on short deadlines.
Refusals we handle
The refusals we work on every week
Express Entry and PR refusals
Including provincial nominee (PNP) refusals and completeness or eligibility findings.
Work permit and PGWP refusals
Including LMIA-based permits and post-graduation work permit eligibility issues.
Spousal and family sponsorship refusals
Genuineness findings and misrepresentation concerns, reopened where possible.
Procedural fairness letters
A warning before a refusal, with a short deadline. The response decides the outcome.
Visitor visa and TRV refusals
Dual intent, ties to home country, and funds concerns addressed head on.
Study permit refusals
Refused for funds, purpose of study, or ties. Often reapplied or challenged successfully.
What can be done
The routes open to a refused applicant
Once we understand your file, one or more of these may apply. We tell you which is realistic for your situation, and we will tell you honestly if the strongest advice is not to spend further.
Respond to the procedural fairness letter
A focused, evidenced response to the officer’s exact concern, filed within the deadline.
Request reconsideration
Where an officer’s decision overlooked evidence or made an error, a reconsideration can be sought.
Reapply, done correctly
A fresh application that directly answers the reasons for the earlier refusal and fills the gaps.
Appeal to the IAD
Where a right of appeal exists, for example many sponsorship refusals, we assess and run the appeal.
Judicial review at the Federal Court
Where a refusal is unreasonable or unfair in law, our in-house barrister can take it to the Federal Court.
An honest read first
Before any of the above, a clear assessment of whether the case is worth pursuing, and how.
Who handles your case
Refused cases are what we are known for
Refusals and complex files are the core of our practice, not a sideline. It is the work we are known for, to the point that other licensed RCICs refer their own clients’ refused cases to us when a file has gone wrong.
Dikshit Soni, Founder and Principal
A Regulated Canadian Immigration Consultant, RCIC R536007, with 14 years on refused and complex immigration files.
A barrister and solicitor in house
Federal Court litigation is handled in house, so a file that must be litigated does not have to leave our office.
Trusted by other consultants
Other RCICs send us their refused cases. That is the clearest measure of where refusal work is done well.
A straight assessment
We tell you whether a refusal is worth challenging, and how, before you commit to anything.
